Stormwater Management Plans/Best Management Practices

The four-year process of developing the new Virginia Stormwater Management Program (VSMP) regulations is complete. The new regulations will  probably become effective in 2011, and it looks as though they are here to stay. Any Efforts to lessen the impact of these regulations by the new Republican Administration would face numerous hurdles beyond the General Assembly:

  • The U.S. Environmental Protection Agency (EPA) has oversight authority for these Stormwater regulations and renewed its threat in testimony to the VSWCB on October 5, 2009 that if the regulations were weakened then EPA would likely revoke approval of this general permit program and require Individual Permits from all projects.
  • Most localities in Virginia will eventually require Municipal Separate Storm Sewer System (MS4) permits from the Virginia Department of Conservation and Recreation (DCR) under another program reviewed by EPA. These MS4 permits will require Stormwater standards – and they could be tougher than state regulations.
  • A Total Maximum Daily Load (TMDL) standard for the Chesapeake Bay is under development by the EPA, as well as individual watersheds. The current VSMP, as well as new VSMP regulations, require compliance with any applicable TMDL per the Clean Water Act.
  • A new EPA proposal was issued (on October 26, 2009) to commence a survey in preparation of a new rulemaking for controlling stormwater by November 2012 

Thus, the EPA has several ways to prevent these regulations from being loosened and has indicated that some elements of the proposed Final VSMP Regulations may not be "tough enough."

Our small size allows the principal to be involved in every project no matter how small. Such attention assures our designs can be completed in a more timely and cost effective manner than the larger engineering and land planning firms.

Doing the plan however is only half the battle. We stand behind our designs and will work with the client to navigate the maze of regulations and permitting processes to insure a timely delivery for approval.  In short we won’t let you get lost in the shuffle.
